1. GENERAL PROVISIONS.
1.1. The Online Store available at www.4ref.eu is run by 4REF limited liability company with its registered office in Białystok at ul. Wiejska 72/70, 15-352 Białystok, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000645680; registry court, in which the company's documentation is stored: District Court in Białystok, XII Commercial Department of the National Court Register; NIP: 5423262230; REGON: 365817646; e-mail address: [email protected], contact phone number: +48 85 888 00 85.
1.2. These Regulations and the Online Store are only addressed to entrepreneurs using the Online Store (The Regulations and the Online Store are not intended for consumers).
1.4.1. WORKING DAY - one day from Monday to Friday, excluding public holidays.
1.4.2. REGISTRATION FORM - a form available in the Online Store that allows you to create an Account.
1.4.3. ORDER FORM - an interactive form available in the Online Store enabling placing an Order, in particular by adding Products to the electronic basket and specifying the terms of the Sales Agreement, including the method of payment.
1.4.4. CUSTOMER - (1) a natural person with full legal capacity for which the use of the Website, including the conclusion of Sales Agreements, is directly related to its business or professional activity (i.e. not being a consumer in this case); (2) legal entity; or (3) an organizational unit without legal personality, which the law confers legal capacity; - who has concluded or intends to conclude a Sales Agreement with the Seller.
1.4.5. CIVIL CODE - the Civil Code Act of April 23, 1964 (Journal of Laws of 1964 No. 16, item 93, as amended).
1.4.6. ACCOUNT - a set of resources in the 4REF ICT system, marked with an individual name (login) and password provided by the Customer, in which data provided by the Customer and information about Orders placed in the Online Store are collected.
1.4.7. NEWSLETTER - electronic distribution service provided by 4REF via e-mail, which allows all customers using it to automatically receive from 4REF cyclical contents of subsequent editions of the newsletter containing information about Products, new products and promotions in the Online Store.
1.4.8. PRODUCT - a service or movable item available in the Online Store that is the subject of the Sales Agreement between the Customer and 4REF.
1.4.9. REGULATIONS - these Regulations of the Online Store.
1.4.10. ONLINE STORE - the Seller's online store available at the Internet address: www.4ref.pl.
1.4.11. 4REF; DEALER; - 4REF limited liability company with its registered office in Białystok at ul. 1.4.12. SALES CONTRACT - a contract for the sale or performance of a Product concluded or concluded between the Customer and 4REF via the Online Store.
1.4.13. ORDER - Customer's declaration of intent submitted via the Order Form and directly aimed at concluding the Product Sales Agreement with 4REF.
2. ONLINE STORE.
2.1. The Product is purchased in the Online Store using the following tools: Account and Order Form.
2.1.1. Account - use of the Account is possible after completing a total of three consecutive steps by the Customer - (1) completing the Registration Form, (2) clicking the " Create Account " field and (3) activating and accepting the Account by 4REF. In the Registration Form, it is necessary for the Customer to provide the following Customer data: name and surname / company name, NIP number, address (street, house / flat number, zip code, city, country), e-mail address, contact phone number and password. Logging in to the Account is done by entering by the Customer in the place designated for it individually set by him during the registration process login and password.

The Customer has the option, at any time and without giving a reason, to remove the Account (resignation from the Account) by sending an appropriate request to 4REF, in particular via e-mail to the following address: [email protected] or in writing to the address: ul. Hurtowa 4 lok. 4, 15-399 Białystok. Opening, maintaining and closing an Account is free.
2.1.2. Order Form - using the Order Form is possible after logging into the individually opened Account. The use begins when the Customer adds the first Product to the electronic basket in the Online Store. Placing an Order takes place after the Customer completes a total of two consecutive steps - (1) after completing the Order Form and (2) clicking on the Online Store website after completing the Order Form field ' Order with payment obligation ' - until then you can modify the entered data yourself ( for this purpose, follow the displayed messages and information available on the Online Store website). In the Order Form, it is necessary for the Customer to provide the following Customer data: name and surname / company name, NIP number, address (street, house / flat number, zip code, city, country), e-mail address, contact telephone number and data regarding Sales Agreements: Product (s), quantity of Product (s), place and method of Product delivery (s), method of payment.
2.1.3. Newsletter - the use of the Newsletter takes place after providing the e-mail address in the "Newsletter" tab visible on the Online Store website, to which subsequent editions of the Newsletter are to be sent and clicking the " Subscribe!" ". You can also subscribe to the Newsletter by selecting the appropriate checkbox when creating an Account - when you create an Account, the customer is subscribed to the Newsletter.
126.96.36.199. The newsletter is sent free of charge for an indefinite period. The customer has the option, at any time and without giving a reason, to unsubscribe from the Newsletter (unsubscribe from the Newsletter ) by sending an appropriate request to 4REF, in particular via e-mail to the following address: [email protected] or in writing to the address: ul. Hurtowa 4 lok. 4, 15-399 Białystok.
2.3. The Customer is obliged to use the Online Store in a manner consistent with the law and decency, while respecting personal rights as well as copyrights and intellectual property of 4REF and third parties. The customer is obliged to enter data consistent with the facts. The customer is prohibited from providing unlawful content. 4REF bears no responsibility for the Customer's use of the Website in a manner contrary to the provisions of the Regulations and contrary to the law. Nor shall he be liable for any content posted, transmitted or published by the Customer during or in connection with the use of the Online Store.
2.4. Complaint procedure:
2.4.1. Complaints related to the operation of the Online Store (excluding the Product complaint procedure, which was indicated in point 6 of the Regulations), the Customer may submit:
2.4.2. in writing to the address: ul. Hurtowa 4 lok. 4, 15-399 Białystok;
2.4.3. in electronic form via e-mail to the following address: [email protected];
2.4.4. It is recommended that the Customer provide in the complaint description: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of irregularities; (2) customer requests; and (3) contact details of the person submitting the complaint - this will facilitate and speed up the processing of the complaint by 4REF. The requirements given in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.
2.4.5. The response to the complaint by 4REF takes place immediately, not later than within 14 calendar days from the date of its receipt. The response to the complaint is sent in the same form in which the complaint was submitted and to the address from which it was received.
3. CONDITIONS FOR CONCLUDING THE SALES CONTRACT.
3.1. The conclusion of the Sales Agreement between the Customer and 4REF takes place after the Customer has placed the Order using the Order Form in the Online Store in accordance with point 2.1.2 of the Regulations.
3.2. The Product price shown on the Online Store website is given in Polish zlotys and includes taxes. About the total price including taxes of the Product being the subject of the Order, as well as about the delivery costs (including transport and delivery charges) and about other costs, and when it is not possible to determine the amount of these fees - the obligation to pay them, the Customer is informed on the Store's pages Online when placing an Order, including when the Customer wishes to be bound by a Sales Agreement.
3.3. The procedure for concluding a Sales Agreement in the Online Store using the Order Form.
3.3.1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order in the Online Store in accordance with point 2.1.2 of the Regulations.
3.3.2. After placing the Order, 4REF will confirm by e-mail that it has accepted the order. Conclusion of the Sales Agreement occurs when the Seller confirms that he has accepted the order and proceeded to its implementation. As soon as the Customer receives the above e-mail, a Sales Agreement is concluded between the Customer and 4REF.
3.4. Consolidation, protection and making available to the Customer the content of the concluded Sales Agreement is made by (1) providing these Regulations on the Online Store website and (2) sending the Customer the e-mail message referred to in point 3.3.2. Regulations. The content of the Sales Agreement is additionally recorded and secured in the IT system of the 4REF Online Store.
4. METHODS AND DEADLINES FOR PAYMENT FOR THE PRODUCT.
4.1. The Seller provides the Customer with the following payment methods under the Sales Agreement:
4.1.1. Payment in cash on personal pickup.
4.1.2. Payment in cash on delivery on delivery.
4.1.3. Payment by bank transfer to the Seller's bank account.
188.8.131.52. Settlements of electronic payments and payment cards are carried out in accordance with the Customer's choice via the Tpay.com website. Electronic payments and payment cards are managed by:

220.127.116.11.1. Settlements of electronic payments and payment cards are carried out in accordance with the Customer's choice via the PayPal website. Electronic payments and payment cards are managed by:

4.2. Payment deadline:
4.2.1. If the Customer chooses payment by bank transfer, electronic payment or payment by credit card, the Customer is obliged to make the payment within 7 calendar days from the date of the Sale Agreement.
4.2.2. If the Customer chooses payment and cash on delivery, the Customer is obliged to make the payment on delivery.
5. COST, METHODS AND DEADLINE FOR DELIVERY AND RECEIPT OF THE PRODUCT.
5.1. Product delivery is available on the territory of the Republic of Poland and to Czech Republic, Slovakia, Austria, Bulgaria, Croatia, Germany, Romania, Slovenia, Hungary, Belgium, Denmark, Holland, Luxembourg, Lithuania, Latvia, Estonia, France, Spain, Sweden, Cyprus, Finland, Greece, Malta, Ireland, Portugal.
5.2. Delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. Product delivery costs (including fees for transport, delivery and postal services) are indicated to the Customer on the Online Store's website in the information tab regarding delivery costs and when placing the Order, including when the Customer wishes to be bound by the Sales Agreement.
5.3. Personal collection of the Product by the Customer is free.
5.4. The Seller provides the Customer with the following methods of delivery or collection of the Product:
5.4.1. Postal delivery.
5.4.2. Courier delivery.
5.4.3. Pallet Shipment.
5.4.4. Personal pickup available at: ul. Hurtowa 4 lok. 4, 15-399 Białystok - on Business Days from 08:00 to 16:00 after receiving prior information that the Product is ready for collection.
5.5. The deadline for delivery of the Product to the Customer is up to 30 Business Days, unless a shorter period is given in the description of the Product or when placing the Order. In the case of Products with different delivery dates, the delivery date is the longest given date, which, however, cannot exceed 30 Business Days. The beginning of the delivery period of the Product to the Customer counts as follows:
5.5.1. If the Customer chooses the payment method by bank transfer, electronic payment or payment card - from the date of crediting the Seller's bank account or settlement account.
5.6. Product readiness for collection by the Customer - if the Customer chooses to collect the Product in person, the Product will be ready for collection by the Customer within 30 Business Days, unless a shorter period is given in the description of the Product or when placing the Order. In the case of Products with different terms of readiness for collection, the term of readiness for collection is the longest period provided, which, however, cannot exceed 30 Business Days. The Customer will be additionally informed by 4REF about the readiness of the Product for collection. The beginning of the product's readiness for collection by the Customer counts as follows:
5.6.1. If the Customer chooses the payment method by bank transfer, electronic payment or payment card - from the date of crediting the bank account or 4REF settlement account.
5.6.2. If the Customer chooses the method of cash on delivery - from the date of the Sale Agreement.
6. PRODUCT COMPLAINTS.
6.1. In accordance with art. 558 § 1 of the Civil Code, 4REF's liability under the warranty for the Product towards the Customer shall be excluded.
6.2. Product Complaints arising from any quality guarantee provided by the manufacturer will be considered on the basis of rules specified for each Product individually, about which the Customer will be notified upon receipt of the Product Delivery.
7.1. In the case of acquisition of 4REF Product , to the installation, maintenance, servicing, repair or liquidation you need a certificate in accordance with Article. 29 of the Act of May 15, 2015 on substances that deplete the ozone layer and on certain fluorinated greenhouse gases (Journal of Laws of 2015, item 881). Product to:
7.1.1. resale is obliged to send to the e-mail address within 7 days of the conclusion of the Sales Agreement a scan of the statement that the purchased product is intended for sale, and thus the customer is not required to have a certificate and undertakes to obtain it from an authorized entity in future;
7.1.2. its assembly by the Customer and / or performing other activities specified in point 7.1. above is obliged to send to the e-mail address within 7 days from the date of the Sale Agreement a statement that the purchased product intended for the above-mentioned purposes and presenting an appropriate certificate of the Customer or entity that will perform the abovementioned activities ordered by the customer.
4REF declares that the sending or delivery of the Product by the Customer depends on the submission of the abovementioned statements and certificates.
7.2. 4REF declares that pursuant to art. 48 point 29) of the Act of 15 May 2015 on substances that deplete the ozone layer and on certain fluorinated greenhouse gases (Journal of Laws of 2015, item 881), conducting business activity without the required certificate is subject to an administrative fine, which may be imposed in the amount from PLN 4,000 to PLN 15,000.
8. ADDITIONAL PROVISIONS.
8.1. The Seller has the right to withdraw from the Sales Agreement concluded with a Customer who is not a consumer within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may occur without giving a reason and does not give rise to any claims on the part of the Customer who is not a consumer against 4REF.
8.2. 4REF has the right to limit the available payment methods, including requiring prepayment in whole or in part, regardless of the payment method chosen by the Customer and the fact of concluding the Sales Agreement.
8.3. When the Product is released by 4REF to the carrier, the non-consumer Customer receives the benefits and burdens associated with the Product and the risk of accidental loss or damage to the Product. In this case, 4REF shall not be liable for any loss, loss or damage of the Product arising from its acceptance for transport until its delivery to the Customer, and for delay in the shipment.
8.4. In the event of sending the Product to the Customer via the carrier, the Customer who is not a consumer is obliged to examine the shipment in time and in the manner adopted for such shipments, in particular he is obliged to check the contents of the shipment at the courier and in the event of any deficiencies or damage to write a damage report at the carrier.
8.5. The Seller's liability towards the Customer, regardless of its legal basis, is limited - both as part of a single claim, as well as for all claims in total - to the amount of the price paid and delivery costs under the Sales Agreement, but not more than to the amount of five hundred Golden. The Seller shall be liable to the Customer only for typical damages foreseeable at the time of conclusion of the contract and shall not be liable for lost profits towards the Customer.
8.6. If the Customer fails to collect the parcel and returns it to the Seller, he has the right to charge the Customer with transport costs.
8.7. All disputes arising between the Seller and the Customer shall be subject to the court having jurisdiction over the seat of the Seller.
8.8. All materials made available by 4REF on the Website, including documents, trademarks, logos and other works, in particular texts, graphics, as well as the selection and arrangement of the content presented on the Website constitute an independent subject of protection under copyright law. The right to use, copy and distribute all data available on the Website is subject to the provisions of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws No. 24, item 83 as amended).
9. FINAL PROVISIONS.
9.1. Agreements concluded through the Online Store are concluded in Polish.
9.2. Change of Regulations:
9.2.1. 4REF reserves the right to amend the Regulations.
9.2.2. In the case of conclusion of contracts of a different nature than continuous contracts pursuant to these Regulations (e.g. Sales Agreement), amendments to the Regulations will not in any way affect the rights of Customers acquired before the date of entry into force of amendments to the Regulations, in particular changes to the Regulations will not affect already submitted or placed Orders and concluded, implemented or executed Sales Agreements.
9.3. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply.
9.4. By creating an Account on the Website, the Customer accepts the content of these Regulations.
